Divorce
When sadly a marriage has broken down one or the other of the parties decide that they want to get a divorce. There are two different ways that you can get a divorce, one is by doing it online yourself and the other is to get us to do it for you.

We make a small charge of £300.00 to do the administrative side of the application to issue a Petition for divorce. On top of that fee will be a Court fee which is currently £593.00*

First an application to the Courts is made. This is called the Petition. The Court will then notify your soon to be ex that you have petitioned for divorce. Your ex partner will then acknowledge the notice of Petition. Once that is received by the Court the Court will issue a notice to state when the hearing will take place. This is not necessarily an attended hearing, it is an administrative process. This is called the Conditional Notice and when that hearing has taken place you are issued with the Decree Nisi. After a time lapse has expired (6 weeks and 1 day) you can then apply to the Court for the Final Order - this is known as the Decree Absolute. Once you have this, your marriage is 'absolutely' over and you are then at liberty to re-marry should you wish to do so.

If you would like to discuss this further then please contact us and we can arrange a FREE telephone or video-link consultation.

*Court fees quoted are correct at the time of writing however, they can change and may not have been updated on this website.
We often have to make it clear to prospective clients that the divorce process is 'entirely separate' to the financial division of the property, monies, savings, pensions and all other assets. It is also entirely separate from any child arrangements for contact etc.

The division of financial affairs is called Financial remedy - please see the relevant page on this site.
