Mediation & Negotiation

There are a number of ways of reaching a settlement with regard to how assets are to be split upon the breakdown of a marriage or civil partnership.

 

One option is mediation (where a neutral third party will offer suggestions for settlement), which can sometimes be the quickest route to achieving a settlement. Another option is for the parties to agree to fully disclose their financial circumstances so that each can receive specific legal advice prior to voluntary negotiations.

If you would like us to deal with the gathering of information and starting the negotiation process then we are very experienced in handling such cases. We will attempt to negotiate an agreed settlement between you and then draft a Consent Order once agreement has taken place. When the draft order is complete it will then need to be sent to the family court for agreement of a District Judge. Once agreed by the Judge the division of all assets and finances can take place.

If agreement cannot be reached then we will need to proceed through the court process. Should that be the case then a further fee is payable due to the extra work that will need to be undertaken.

FIXED FEE £1,795 (No VAT)
If proceeding through the courts then an extra £1,000 is payable.

When we are not involved in mediation/negotiation and we are going to court.

If you have already tried to mediate or negotiate a settlement and it has not worked out, then we are able to take your case on and organise everything to take the matter through the court process. This can be up to three court hearings.
